By accessing or using the website located at sanpablomasonry.com(the "Site"), submitting an estimate request, or engaging San Pablo Masonry ("we," "us," or "our") to perform any services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use the Site or engage our services.
We may update these Terms and Conditions from time to time. The current version is always posted on this page with the effective date shown above. Continued use of the Site or our services after any update constitutes your acceptance of the revised terms.
San Pablo Masonry is a masonry contractor serving San Pablo, California and surrounding East Bay communities. Our services include, but are not limited to, foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, walkway construction, brick wall installation, stone masonry, and related masonry work.
All services are subject to a signed written agreement between you and San Pablo Masonry prior to commencement of work. Nothing on this Site constitutes an offer or guarantee to perform services at any particular price or timeline until a written agreement is signed by both parties.
Estimates provided by San Pablo Masonry are based on an on-site assessment of the work and the conditions observed at the time of that assessment. All estimates are provided in writing.
An estimate is not a guaranteed final price. The final cost of a project may change if unforeseen conditions are discovered during the course of work - for example, hidden structural damage, soil conditions that differ from what was observed, or changes requested by you after work has begun. Any changes to the original scope of work will be communicated to you in writing before additional work proceeds.
Estimates are valid for 30 days from the date of issuance unless otherwise stated in writing.
Work dates and times are scheduled by mutual agreement and confirmed in writing. We ask that you notify us at least 48 hours in advance if you need to reschedule.
If you cancel a scheduled project after a written agreement has been signed and materials have been ordered or work has begun, you may be responsible for costs incurred up to the point of cancellation, including materials purchased, permit fees paid, and labor performed. The amount owed will be documented and communicated to you promptly.
We reserve the right to reschedule work due to weather conditions, equipment issues, or other circumstances outside our control. We will notify you as early as possible in those situations and work with you to find a suitable replacement date.
Payment terms are specified in the written agreement for each project. In general, a deposit may be required before work begins, with the remaining balance due upon completion. Specific terms vary by project size and scope.
Payments are due as specified in your written agreement. Unpaid balances past the due date may be subject to a late fee and collection action. We reserve the right to place a mechanics lien on the property in accordance with California lien law if payment is not received.
Accepted payment methods are specified at the time of your written agreement.
You agree to provide safe and reasonable access to the work area on the agreed-upon dates. This includes ensuring that pets are secured, that vehicles are moved as needed, and that the area is reasonably clear before work begins.
You are responsible for disclosing any known conditions that could affect the work - including underground utilities, buried structures, prior repairs, or known soil or drainage issues. We are not liable for damage caused by conditions you failed to disclose.
Where a permit is required by the City of San Pablo or Contra Costa County for the work being performed, we will obtain that permit on your behalf as part of the project. Permit fees are included in or added to your written estimate.
All work is performed in accordance with applicable local building codes and the requirements of the California Contractors State License Board.
Warranty terms, if any, are specified in the written agreement for each project. Warranties cover defects in workmanship for the period stated in that agreement.
Warranties do not cover damage caused by events outside our control - including but not limited to seismic activity, soil movement beyond normal seasonal variation, flooding, vandalism, or modifications made by you or another contractor after our work is complete.
THE SITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, ABOUT THE ACCURACY, COMPLETENESS, OR FITNESS FOR A PARTICULAR PURPOSE OF THE INFORMATION ON THIS SITE.
To the fullest extent permitted by applicable law, San Pablo Masonry shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of this Site, your reliance on information contained on it, or any services we perform, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from services we perform shall not exceed the amount you paid us for the specific project giving rise to the claim.
If a dispute arises between you and San Pablo Masonry related to services performed or these Terms, we ask that you first contact us directly to attempt to resolve the matter informally.
If informal resolution is not possible, disputes shall be resolved through binding arbitration in San Pablo, California, under the rules of the American Arbitration Association, unless you and we agree to a different process in writing. You waive any right to a jury trial or to participate in a class action related to our services.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts located in Contra Costa County, California.
All content on this Site - including text, images, logos, and design - is owned by or licensed to San Pablo Masonry and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written permission.
